1. Scope of Agreement

Use of the services offered to you by Hungarotickets GmbH, A-1010 Vienna, Stadiongasse 5/15 (“motorsportidx”) on motorsportidx.com (“Website”) is offered to you on your acceptance of these terms of use (“Terms”). If you have not already otherwise expressly agreed to these Terms, your use of this Website indicates your agreement. If you do not agree to these Terms, you may not use the Website.

motorsportidx reserves the right to change the Terms at any time and at its sole discretion. The most recent version of the Terms will be indicated as such and will be published on the Website under “Terms of Use”. You are responsible for regularly reviewing these Terms. When and to the extent to which motorsportidx makes changes to or modifies the Terms in the future, it will publish changes on the first page of the homepage accordingly, and point out the modifications to the users. Any subsequent use by you of this Website following the publication of changes to the Terms constitutes your acceptance of all such changes.

2. Scope of Services, Disclaimer of Liability

motorsportidx provides the users of this Website with a search engine in form of a directory with search options (“Search Engine“) which is available free of charge until revoked. The links to Hungarian websites and websites relating to or containing information about Hungary are displayed in categories. Links are on the one hand incorporated by external editors, and on the other hand added by direct submission through website owners. motorsportidx does not have a bearing on the collection of links, search results and retrieved information and does not adopt them as its own. Accordingly, motorsportidx shall not be responsible for links, search results and retrieved information (§14 E-Commerce Act).

motorsportidx cannot guarantee the completeness, reliability, or timeliness of the links, search results, website descriptions, evaluations, comments or any other information and contents contained on this Website. Quite the contrary, it is an innate fact of the nature of internet that links and search results cannot be complete and up-to-date. As the Website is designed as an open platform it is furthermore impossible to guarantee for the reliability and objectivity of website descriptions and evaluations. These descriptions and evaluations are first and foremost subjective opinions of third parties. motorsportidx can furthermore not guarantee that the Website or the services will be uninterrupted or error-free. Owing to these reasons, and also to the fact that services are offered free of charge, motorsportidx shall in no event be liable for services and contents offered on the Website.

motorsportidx furthermore reserves the right to discontinue at any time, and also without notice to you, temporarily or even permanently, any part or all of the services offered on the Website.

3. Evaluations, Comments of Users

motorsportidx enables you to evaluate links through an Evaluation System. This right remains in effect until revoked. A separate registration furthermore enables you to post comments on links. The evaluations and comments serve the purpose of making the search results more scalable for other users. When posting an evaluation or a comment you are obliged to follow objective criteria, to not infringe upon rights of third parties, and especially to pay respect to the guidelines. You bear the sole responsibility for the contents posted by you, and you are thus obliged to indemnify and hold motorsportidx harmless from and against any and all third-party claims (including fines and penalties as well as costs of legal representation arising from legal or official measures) resulting from your postings. This also holds true for third-party claims relating to the lawful use by motorsportidx or by third parties of the contents posted by you.

You grant motorsportidx the irrevocable, royalty-free, perpetual, unrestricted, and worldwide right to use, utilise and adapt comments posted by you in any way known and in any way that will be known in the future and to hand them on to third parties, who may use, utilise and adapt the contents in the same unrestricted and royalty-free way as motorsportidx. motorsportidx furthermore reserves the right to delete parts of or entire comments and evaluations posted by you at any time and without stating reasons. This holds true particularly for, but is not limited to, cases of suspected rights infringement or evaluation spam.

When you post an evaluation or a comment on the Website, motorsportidx registers your IP address. Comments can furthermore only be posted by users who submit their names and email addresses. You are obliged to submit your name and email address truthfully. Please observe the applicable provisions of the privacy policy.

4. Rights of Editors

Inspired by the spirit of Open Source, the Website gives you the possibility of applying via email to editors@motorsportidx.com as an editor for a category of the Website. As an editor, you can participate in the development of the Search Engine and thus actively contribute to its design. When applying, please observe the respective guidelines. 5. Unlawful Links, Comments

motorsportidx makes diligent efforts to keep its search engines free of links with unlawful content. The same holds true for unlawful comments by users. Owing to the great number of links and comments, however, motorsportidx is not able to pro-actively check all of the above for unlawful content. This is the reason why motorsportidx needs your help to get rid of links to websites with unlawful content and comments of third parties: if you find such a link or comment, please report it to abuse@motorsportidx.com. If there is reasonable suspicion, motorsportidx will delete the link or comment and, if applicable, take further legal action. It is possible, however, that a deleted link or a link similar to a deleted link or comment of a third party is reregistered. In such a case we kindly ask you to report such a link or comment again to the above mentioned email address.

6. Copyright protection

Elements on the Website, such as text, pictures, illustrations, as well as design and structure of the Website and links, actual search results, structure and contents of the database and the search program are subject to copyright protection and the protection of intellectual property. Unless motorsportidx expressly agrees in writing, these elements may not be copied, modified or utilised.

7. Severability

In the event that any or more of the provisions contained in this Agreement is, for any reason, held to be unenforceable or invalid, it will not affect the validity or enforceability of the remaining provisions and the unenforceable or invalid provision will be replaced by an enforceable provision which is closest to the intention of the underlying provision.

8. Choice of Law and Court of Jurisdiction

Any legal dispute arising from the use of the Website shall be governed exclusively by Austrian substantive law, without giving effect to any principles of conflicts of law.

All disputes directly or indirectly relating to or in connection with the use of the Website, including the question of the applicability of the terms and conditions, shall be governed exclusively by the Austrian court having jurisdiction ratione loci and ratione materiae for 1010-Vienna, Austria. This Agreement only applies to consumers as set out in the Austrian law on consumer protection if they have neither their residence nor their habitual abode in Austria and if they do not work in Austria.
